Issues for the Zoning and Natural Resources Committee to consider: <br /> 1.Should the land owned by Kenneth Olson and Earl Olson be considered <br /> one farm for purposes of determining density acreage? <br /> Facts: a. Although the land may have been farmed as one ownership, the <br /> township map from the time of plan adoption lists them as two <br /> separate farms. <br /> b. The enclosed land contract recorded November 11 1983 <br /> transferred ownership of what was previously the Earl Olson <br /> farm to Kenneth Olson. This recognized the land as being <br /> under separate ownerships. <br /> c. According to Donald Piepenburg, Black Earth town Supervisor, <br /> split rights apply to grantees, heirs, successors, and assigns. <br /> Since Earl Olson transferred this property, and hadn't divided it <br /> previously, it should be counted with the rest of the Kenneth <br /> Olson farm in determining total number of splits. <br /> 2. In determining the number of splits, should a land division which <br /> occurred after plan adoption (CSM 6948 lot 1, recorded December 4, <br /> 1992) count as a split if it had a pre-existing farmhouse on it? <br /> Facts: a. According to Norbert Scribner, the date of the division is the <br /> important issue, which in this case occurred after the date of <br /> plan adoption. Therefore, the split should be recognized as <br /> counting towards the total number of allowable splits. <br /> b. According to Vernon Wendt, the Town of Black Earth looks <br /> at whether or not the home on the property was built before the <br /> time of plan adoption. <br /> 3. In determining the number of splits, should only contiguous farm <br /> acreage on the original farm be considered or should all acreage owned <br /> by the original farmer in the township be considered? <br /> Facts: a. According to Vernon Wendt, the Town of Black Earth determines <br /> total acreage based on the sum total of all original farm acreage, <br /> irregardless of whether or not it is contiguous. <br />
