DANE COUNTY ORDINANCE AMENDMENT NO. 6993 Amending Section 10.03 relating to Zoning Districts in the Town of York. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of York be amended to include in the C-2 Commercial and RH-1 Rural Homes Districts the following described land: PETITION NUMBER: 6993 Part of the S 1/2 SE 1/4 Section 6, Town of York described as follows: TO RH-1: Part of Lot #1 Certified Survey Map #7749, being part of the SW 1/4 SE 1/4 and part of the SE 1/4 SE 1/4 of Section 6, Town of York described as follows: beginning at the Southwest corner of said Lot #1; thence N 06° 42' 36" East, along the Westerly line of said Lot 1, 572.81 feet; thence S 51° 17' 41" East, along the Northeasterly line of said Lot #1, 250.06 feet; thence S 10° 45' 22" West, 251.26 feet; thence S 79° 14' 38" East, 121.32 feet; thence N 10° 45' 22" East, 186.89 feet; thence S 51° 17' 41" East, along the Northeasterly line of said Lot #1, 193.60 feet; thence S 71° 50' 25" West, along the North line of Kraus Road, 48.88 feet; thence S 22° 04' 33" West, along the Northwesterly line of Kraus Road, 143.83 feet; thence S 50° 51' 42" West, along the Northerly line CTH V 40.45 feet; thence S 78° 18' 18" West, along the Northerly line of CTH V, 152.94 feet; thence S 89° 52' 26" West, along the North line of CTH V, 238.68 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. The C-2 and RH-1 parcels shall remain in the same ownership. 2. The only use allowed in the C-2 shall be for vehicle repair. Said restriction shall run in favor of Dane County and the pertinent-Town-Board as well as the owners of land within 300 feet of the site.
