Grounds for Objection <br /> 1. F. H. Raemisch and Sons, Inc. has specifically waived all rights to <br /> conduct mineral excavation activities on the proposed C.U.P. site and has <br /> further specifically waived the right to make the application it is currently <br /> making. The agreement entered into between F. H. Raemisch and Sons, <br /> Inc., by Franklin H. Raemisch, and the Village of Waunakee dated May 24, <br /> 1994 and incorporated into Dane County Conditional Use Permit #1133-C <br /> specifically states: <br /> After expiration of Conditional Use Permit (No. 1133), no blasting, <br /> mining or excavation shall be permitted in any portion of the area <br /> marked as "Endres or Ripp Expansions" on Exhibit A attached hereto. <br /> On or after the date hereof, the Operator shall not apply for any <br /> extensions of existing quarry operations on the Endres or Ripp <br /> Expansions as shown on exhibit A. (emphasis added) <br /> Exhibit A is a map, a copy of which is attached, which shows that the Ripp <br /> Expansion is the same approximate 200 foot strip described in the written <br /> statement of Franklin H. Raemisch which has been filed with C.U.P. <br /> application #1447. <br /> The current owners of homes in the subdivision have relied to their <br /> detriment on the above promise by purchasing and building homes in <br /> Waunakee Heights with the understanding that the existing quarry <br /> operation will not be expanded onto adjacent lands as is now being <br /> proposed. <br /> 2. The application is insufficient under ordinance #10.191 as it does not <br /> contain a specific time schedule, a specific site plan or a topographic <br /> reclamation plan. All references are vague, open-ended and inexact. <br /> 3. The proposed mineral extraction cannot satisfy the requirements of <br /> 10.38 (h) as mineral extraction by blasting will without doubt be <br /> detrimental to the safety and comfort of the residents of Waunakee <br /> Heights and opening of the land diminish the value and existing use of the <br /> current residents' property. Furthermore, it is highly likely that the <br /> proposed conditional use will impede the further development of the <br /> subdivision and that it may detrimentally effect drainage and exisiting site <br /> improvements in the subdivision. <br />
