DANE COUNTY ORDINANCE AMENDMENT NO. 7023 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Dunn. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Dunn be amended to include in the A-B Agricultural Business <br /> District/s the following described land: <br /> PETITION NUMBER: 7023 <br /> The following described parcel is part of Lot#4 of Certified Survey Map#1497, lying in the NW 1/4 NW <br /> 1/4, and together with part of the NW 1/4 NW 1/4, of Section 10, Town of Dunn described as follows: <br /> Commencing at the Northwest corner of said Section 10; thence N 89° 00' 27" East, 264.16 feet, along <br /> the North line of said Section 10,to a point that is 16 rods East of, at right angles to,the West line of said <br /> Section 10 and the point of beginning of this description; thence S 01° 00' 05" West, 986 feet, more or <br /> less, along a line that is parallel to, and 16 rods Easterly of, the West line of said Section 10, to the <br /> centerline of Exchange Street,as it now exists;thence S 82°49' 32"East,41 feet,along said centerline of <br /> Exchange Street; thence along said centerline, being a curve to the left, having a radius of 410.00 feet, <br /> and a chord bearing N 64° 08' 32" East, 443.48 feet; thence N 31° 24' 27" East, 38.2 feet, along said <br /> centerline; thence N 58° 35' 33" West, 315.4 feet, parallel to the Southwesterly line of Lot #3, of said <br /> Certified Survey Map#1497, to the Northwesterly line of said Lot#4; thence N 19° 35' 46" West, 134.9 <br /> feet, along said Northwesterly line of said Lot #A ence N 31° 24' 27" East, 300 feet, parallel to the <br /> Northwesterly line of Lots 3,2 and 1 of sal,' " 'urvey Map#1497; thence S 58°35' 33"East, 110 <br /> feet, along the Northwesterly exten0- erly line of Lot #1 of said Certified Survey Map <br /> #1497, to the most Northerly - 'ice N 31° 24' 27" East, 69.46 feet, along the <br /> Westerly line of the lap,' Ila;thence N 03° 28' 27"East, along the West <br /> line of the lands owns ° North line of Section 10; thence S 89° 00' <br /> 27" West, 518.64 feet, the point of beginning of this description.\\N _.LNG <br /> Conditional zoning is hereby ii ,.ction 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area s .L to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Parcel 2 and 3,per parcel map dated October 1, 1997,can be used for nursery only,and growing and <br /> growing and selling Christmas trees. <br /> 2.Parcel 4,per parcel map dated October 1, 1997,can be used for nursery only and growing and selling <br /> Christmas trees. An additional restriction is that no lighting or amplified sound will be allowed. <br /> 3.Parcel 5,per parcel map dated October 1, 1997,will be used for growing Christmas trees only.No <br /> amplified sound or lighting allowed.Parcel 5 can be used for"you cut" Christmas trees. <br /> 4.Provide for a 15 foot buffer zone between Parcel 5 and all adjacent neighbors. Applicant shall plant and <br /> maintain spruce trees in this buffer zone,trees shall be 5 feet or larger. <br /> 5.The applicant shall also plant and maintain a lining screen and trees, 5 feet or larger,between parcel 1 <br /> and parcel 3 in order to provide privacy and security for the parcel 3 residence and yard. In the corner of <br /> parcel 3 and parcel 4 the applicant will plant additional trees. <br /> 6. The applicant shall correct any water run off as a result of further expansion of the nursery's water <br /> system should this become a problem to the owners of the down slope lots. <br /> 7.Nursery use shall be the only use allowed in the A-B district. <br /> The Dane County Board of Supervisors does ordain that this amendment,based upon their findings,to be <br /> consistent with the provisions of Wisconsin State Statute 91.77(1)(a),(b),(c). <br />
