This proposed division of two residential parcels appears to conflict with policies in the <br /> Agricultural Preservation Area of the Town of Oregon. The relevant policies for this area are: <br /> 15. In addition to the requirements listed in#14 above,petitions for rezoning lands in the <br /> Agricultural Preservation Category from A-1 Exclusive to other zoning districts shall <br /> only be considered for approval by the Town if all of the following criteria are met: <br /> a) The activity allowed by the proposed rezone will not convert land that has been devoted <br /> primarily to agricultural use. <br /> b) The activity allowed by the proposed rezone will not limit the surrounding land's <br /> potential for agricultural use. <br /> c) The activity allowed by the proposed rezone will not conflict with agricultural <br /> operations on the remaining parcel subject to a farmland preservation agreement. <br /> d) The activity allowed by the proposed rezone will not conflict with agricultural <br /> operations on other properties. <br /> 16. In no circumstances shall development in the Agricultural Preservation Category exceed a <br /> density of one dwelling unit per 35 acres of contiguous land owned. <br /> Comments: <br /> a. This site is currently a productive cornfield. According to the information submitted by the <br /> applicant, 80%of the land has soils in Classes I&II, with the other 20%in Class III. These <br /> are among the most productive soils. The application also states that 100%of the land in this <br /> parcel is cropland. <br /> b. The proposed residential parcels leave a small piece of the cropland up to CTH A <br /> (approximately 4 acres) which will be more difficult to farm because of the two lots proposed. <br /> c. The main conflict is the proposed removal of 16 acres of productive land, plus the small <br /> remaining parcel north of the proposed residential site. <br /> d. There is active farming all around this site. Depending upon who lives in the proposed new <br /> houses, there could always be conflicts with commonly accepted farming practices. <br /> 16. This applicant has 78 acres; therefore, creating two lots does not conflict with the density policy. It <br /> does appear to conflict with policies to protect productive farmland. <br /> ENVIRONMENTAL HEALTH <br /> None. <br /> DANE COUNTY HIGHWAY <br /> None. <br /> OTHER <br /> None. <br />
