Per Dane County Code of Ordinances (DCCO), Chapter 10: Zoning— <br /> 10.04 RESTRICTIONS UPON LANDS,BUILDINGS AND STRUCTURES. <br /> (1) (b)Accessory buildings. <br /> 6.Setback requirements, side yard. <br /> c. All other accessory buildings over 120 square feet in size shall be located not less than ten(10) <br /> feet from any side lot line, unless eligible for a reduced size yard setback under s. 10.16(6). <br /> d. All other accessory buildings less than 120 square feet in size shall be located not less than four <br /> (4) feet from any side lot line, unless eligible for a reduced side yard setback under s. 10.16(6). <br /> e. Accessory buildings located between the front and rear building lines of a principal residence <br /> shall conform to the minimum side yard requirements for principal buildings specified in the <br /> respective district regulations of this ordinance <br /> 7.Setback requirements, rear yard. <br /> c. All other accessory buildings over 120 square feet in size shall be located not less than ten(10) <br /> feet from any rear lot line, unless eligible for a reduced rear yard setback under s. 10.16(6). <br /> d. All other accessory buildings less than 120 square feet in size shall be located not less than four <br /> (4) feet from any rear lot line, unless eligible for a reduced rear yard setback under s. 10.16(6). <br /> Sec. 10.16 GENERAL PROVISIONS AND EXCEPTIONS. <br /> (6)Rear yards. <br /> (a) Location of accessory buildings in rear yards. <br /> 2. On interior lots less than 60 feet in width no accessory building shall be erected,moved or <br /> added to so as to be nearer than two and one-half(2-1/2) feet to a side or rear lot line; provided, <br /> however, if the front building line of any accessory building is located closer than 10 feet from the <br /> rear building line of a residence, the same side and rear yards as required for a principal or <br /> residential building shall be maintained. <br /> Sec. 10.25 ADMINISTRATION, ENFORCEMENT AND PENALTIES. (1)Zoning administrator. (2) <br /> Zoning permits. (a)No new building shall hereafter be erected, and no existing building shall be added to, <br /> structurally altered, moved or changed in use, nor shall any nonconforming building be repaired or <br /> restored, in any district, until a zoning permit has been issued, except as otherwise provided by law or <br /> ordinance. <br /> This letter serves as notice that your property at 308 Memphis Ave is in violation of the ordinance. An <br /> inspection conducted on November 4 disclosed a residential accessory building greater than 120 square <br /> feet constructed without a zoning permit. <br /> 12.03 ZONING PERMIT FEES FOR NEW CONSTRUCTION,ADDITIONS AND <br /> ALTERATIONS (2)For additions to or alterations of existing single family, duplex and mobile home <br /> residences, and for buildings accessory to single family, duplex and mobile home residences, the fee shall <br /> be $50.00 plus $0.075 for each square foot of added floor area, including basements and attached garages. <br /> Late Filing Fee: Where work has begun before a permit has been obtained the fee shall be doubled. <br /> You are hereby instructed to apply for a zoning permit within 10 days of the date of this letter and adhere <br /> to Dane County Chapter 10: Zoning regulations, or the accessory building must be removed. Please <br /> contact the Zoning Department at(608) 266-9084 so that the corrections can be verified. <br />
