A <br /> AGREEMENT FOR <br /> PRELIMINARY DEVELOPMENT REVIEW <br /> IN THE TOWN OF WESTPORT, DANE COUNTY, WISCONSIN <br /> • (HOVDE/KENNEDY DEVELOPMENT) <br /> THIS AGREEMENT is entered into between the Town of Westport ("Town"), a <br /> Wisconsin municipal corporation, and GJH Group, LLC and the Bernard and Louise <br /> Kennedy Trust ("Developers"). <br /> WHEREAS, Developers wish to develop property located within the Town lying <br /> between West River Road and Kennedy Drive (see attached map) for commercial use and <br /> to obtain Town approval of this development in accordance with applicable State laws and <br /> Town ordinances; and <br /> WHEREAS, Developers have asked the Town to: (1) add the property to its water <br /> district; (2) request the addition of the property to the Central Urban Service Area; (3) <br /> amend the Town's Land Use Plan; and (4) consent to rezoning the property to C-2 (with <br /> restrictions), all in anticipation of development, and likely division of the property; <br /> WHEREAS, the Town agrees to review the preliminary plan of development of <br /> Developers in accordance with the law and desires to have such review made without <br /> unreasonable expense to Town taxpayers; <br /> NOW, THEREFORE, for and in consideration of the mutual covenants contained <br /> herein, and for good and valuable consideration, pursuant to the Town's ordinances and <br /> as allowed by law, the parties agree as follows: <br /> Developers agree to pay all administrative costs incurred by the Town for <br /> processing, study and review of the preliminary plan of development, including without <br /> limitation because of enumeration, legal and engineering service costs and general <br /> administration costs incurred by the Town in connection with this review. <br /> It is understood that such costs will be incurred for the development procedures <br /> noted above and any other services or costs incurred by the Town which benefit the <br /> Developers in the development of the property described above. <br /> H:\WIP\8006\86\HOVDEAG.TGW <br /> 0103961049 1 <br />
