A r A <br /> Page 2 <br /> Pet. #6437 <br /> Resolution #95-40: <br /> 1 . Water shall be provided to the development contemplated in the <br /> Plat by the proposed Town public water system. The Town Engineer <br /> shall review and approve the design of the water system included <br /> within the plat property. <br /> 2 . All utilities shall be installed underground, and their <br /> location approved by the servicing utilities. <br /> 3. Erosion control and stormwater drainage and runoff plans shall <br /> be approved by the Town Engineer. <br /> 4 . Documentation from the Town Engineer stating that road, sewer, <br /> water stormwater detention/retention, and other required public <br /> improvements, have met Town standards . <br /> 5. Contracts entered into by the Town and Developer for all public <br /> improvements shall be reviewed and approved by the Town Attorney <br /> and Town Engineer. <br /> 6. A Development Agreement between the Town and Developer, in a <br /> form acceptable to the Town Attorney, shalll be executed requiring <br /> the Developer to pay Town Engineer and Town Attorney review fees . <br /> Fees for any and all reviews are to be paid to the Town prior to <br /> the Town' s plat approval signature. <br /> 7 . A letter of credit for contemplated road, sewer, water, <br /> stormwater detention/retention, and other required public <br /> improvements shall be required in amounts approved by the Town <br /> Engineer and in a form approved by the Town Attorney. <br /> 8 . The Town shall accept parkland as noted on the plat, as may be <br /> added to the plat and aprpoved by the Town, and/or fees in <br /> satisfaction of the Town' s parkland dedication requirements. <br /> 9. The Town Attorney shall review and approve all deed <br /> restrictions proposed by the Developer prior to the Clerk' s <br /> signature on the final plat. <br /> 10 . The Developer shall comply with any rules, regulations, and <br /> permits of County, State or Federal agencies with respect to the <br /> sewerage system, wells, erosion control, stormwater drainage <br /> control, and construction erosion and drainage control measures, as <br /> well as all provisions of Town Ordinances. <br /> 11 . No commercial truck traffic or service shall be allowed on <br /> Rankin land for services being provided to lots along North Sea <br /> Road. <br /> 12 . Steps shall be taken by the Developer to discourage residential <br /> traffic on North Sea Road from Rankin Lane, and to encourage such <br /> traffic to access North Sea Road from Enchanted View Drive. <br /> 13 . Proper Zoning shall be obtained so as to allow either one <br /> duplex or one single family home for each of the lots created to <br /> the West of North Sea Road, and so as to allow one single family <br /> home on each of the lots created North of Rankin Lane and East of <br /> North Sea Road. <br /> 14 . A public sanitary sewage system to provide public sewer to all <br /> developed lots shall be required for development of the property. <br />
