V32195P 63 <br /> DECLARATION OF COVENANTS,RESTRICTIONS AND CONDITIONS FOR LOT 1 AND <br /> LOT 2 OF CERTIFIED SURVEY MAP # 8099, TOWN OF DEERFIELD,DANE COUNTY, <br /> WISCONSIN. <br /> Lorraine A. Thorstad,owner of real estate in the Town of Deerfield, Dane County,more <br /> particularly described as Lot One(1)and Lot Two(2)of CSM 8099 ,recorded in Volume 43 of <br /> Certified Surveys at pages 165,166,167 as Document No. 2738460 in the Dane County Registry, <br /> hereby declares that aforementioned Lot 1 and Lot 2 are subject to the following covenants, <br /> restrictions and conditions: <br /> 1. See Page 1 of CSM#8099 which is attached hereto and incorporated herewithin and <br /> has been modified to indicate a Neutral Zone and a No-Build-Big area. Said Neutral Zone is 100 <br /> feet wide, i.e. 50 feet on each side of the Southerly/Northerly boundaries of Lot 1 and Lot 2. <br /> There is to be no tree/vegetation removal, change of existing grade, or building of any structures <br /> in said Neutral Zone without written agreement from the other Lot owner,with the exception of <br /> Owner of Lot 2 building and maintaining that lot's driveway. Also,there is to be no permanent <br /> structure greater than 50 square feet of"footprint" within the first 150 feet south of the highway <br /> lying west of Lot 1 (No-Build-Big Area). <br /> 2. Nuisances Prohibited. No noxious or offensive trade or activity shall be carried on <br /> nor shall anything be done which may be or will become a nuisance to the neighborhood. <br /> Nuisances such as loud or unreasonable noise shall not be permitted to exist upon any lot so as to <br /> be detrimental to the other lot or it's occupants. Manure shall be disposed of by removal or <br /> spreading and shall not be allowed to excessively accumulate to cause health or odor problems. <br /> Exterior lighting shall not be directed in such a manner as to create an annoyance to neighbors. . <br /> Trash and garbage containers shall not be visible to the public except on days of trash collection. <br /> Excessively barking dogs,braying asses or other animals making excessive noise shall be <br /> considered nuisances and shall be quieted or removed upon reasonable complaint. <br /> 3. Changes. These restrictions or any part thereof may be canceled,released,amended or <br /> waived in writing as to one or both of the lots subject to this declaration by any instrument <br /> signed by both owners of the lots subject to this declaration. <br /> 4. Enforcement <br /> a. Remedies for Breach. Violation or breach of any provision of this Declaration herein <br /> contained shall entitle either owner of the Lots subject to this Declaration to prosecute a <br /> proceeding in any court of competent jurisdiction against the person or persons who have <br /> violated or are attempting or threatening to violate any of this Declaration and may enjoin any <br /> such violation or breach, and may prosecute any and all remedies permitted them at law or in <br /> equity. <br /> b. Deemed to Constitute a Nuisance. The result of every action or omission whereby <br /> any provision of this Declaration herein contained is violated in whole or in part is hereby <br /> declared to be and to constitute a nuisance and every remedy allowed by law or equity against an <br /> l <br />
