6-444,/ 17-92 <br /> WRITTEN STATEMENT REQUESTING REZONING APPROVAL <br /> HAGEN FARM SITE <br /> DANE COUNTY, WISCONSIN <br /> Waste Management of Wisconsin, Inc . (WMII) , is performing the <br /> remediation of the Hagen Farm Site in accordance with a Unilateral <br /> Administrative Order (UAO) issued by the United States <br /> Environmental Protection Agency (USEPA) under Section 106 of the <br /> Comprehensive Environmental Response, Compensation and Liability <br /> Act of 1980, as amended by the Superfund Amendments and <br /> Reauthorization Act of 1986 (CERCLA) , 42 U.S .C. , Section 9601, et <br /> sect. The Wisconsin Department of Natural Resources (WDNR) , is also <br /> involved in the oversight of this remediation work. <br /> As a part of this remediation work, WMII is required to build a <br /> groundwater extraction and treatment system to remediate the <br /> groundwater in the vicinity of the site . The Hagen Farm site <br /> property that WMII owns in Dane County is currently zoned A-1 <br /> (Exclusive Agricultural) . Under this zoning, the construction of <br /> the building and the other components of the extraction and <br /> treatment system are not allowed. Therefore, WMII requires the <br /> rezoning of a portion of the site property that WMII owns in order <br /> to obtain a Dane County building permit and complete the <br /> construction of the groundwater extraction and treatment system and <br /> the protective building that will cover the treatment system. The <br /> new zoning classification being requested by WMII is A-2 , <br /> Conditional Use - Agricultural . <br /> The completion of the construction of this groundwater extraction <br /> and treatment system is currently scheduled to be completed by <br /> February 29, 1996 . Under the terms of the UAO issued by USEPA to <br /> WMII, if the construction of the system is not completed by this <br /> date, WMII could face the payment of penalties to USEPA of up to <br /> $25, 000 per day.
