UU1 WU_, <br /> MaLQUEENDATIO <br /> RE: CUP 1298 <br /> The Planning Commission of the Town of Burke conducted a <br /> public hearing on January 10, 1996, regarding application for <br /> Conditional Use Permit No. 1298, ("CUP 1298") for a mineral <br /> extraction quarry at the Ed Reiner Property, located at 3060 Reiner <br /> Road. Additionally, the Planning Commission received information <br /> regarding CUP 1298 at its meetings on December 13, 1995, and <br /> January 24, 1996. After fully considering all of the information <br /> it has received regarding CUP 1298, the Planning Commission, at its <br /> meeting on February 1296, makes the following recommendations to <br /> the Town Boards 9 <br /> The Planning Commission recommends that the Town Board <br /> for the Town of Burke recommend to the Dane County Zoning <br /> Committee that the application for CUP 1298 be denied. <br /> If the Town Board, or subsequently, the Dane County <br /> Zoning Committee or Dane county Board, declines to accept <br /> the above recommendation, the Planning Commission further <br /> recommends that the Town Board request that conditions be <br /> place on CUP 1298 and specifically agreed to between the <br /> IA' CUP applicant and the Town of Burke to mitigate <br /> and/or avoid negative impacts arising from the mineral <br /> extraction quarry operation and that the Town of Burke be <br /> allowed to make recommendations regarding such <br /> conditions, with the Town's Planning commission to hold <br /> a public hearing and make recommendations to the Town <br /> Board concerning conditions to be placed on CUP 1298 . <br /> In making these recommendations, the Planning Commission finds: <br /> 1. A mineral extraction quarry is not consistent with the <br /> significant residential uses (inventoried at within <br /> radius) that have developed and axe cons nuing to <br /> develop in the area of the proposed quarry site and is not <br /> consistent with the draft land use plan that is under <br /> Consideration by the Town of Burke and anticipated to be <br /> submitted to the electorate for approval in April 1996. <br /> 2. The establishment, maintenareC and operation of a mineral <br /> extraction quarry will be detrimental to or endanger the <br /> public health, safety, comfort and general welfare in the <br /> following respects: <br /> a. The proposed quarry site is located very near a high <br /> pressure 12 inch natural gas mains quarry operations <br /> including blasting and truck and heavy equipment movement <br /> pose a significant risk of causing a rupture or leak of <br /> this main, with resulting explosion or firs and damage to <br /> surrounding properties, including residences. At this <br /> point in time, there are no state or federal regulations <br />
