The Agriculture, Environment & Zoning Committee of the Dane County Board, pursuant to its powers and after a public <br /> hearing, the applicant for Conditional Use Permit No. $ 39 or his agent being afforded and opportunity to pre- <br /> sent relevant facts supporting the application, and after hearing all persons opposing such application, does here- <br /> by make the following conclusions: <br /> 1. That the establishment, maintenance, and operation of the r proposed_conditional-use will..not be detrimental to or en- <br /> danger the public health, safety, morals, comfort or general welfare. <br /> 2. That the uses, values and enjoyment of other property in the neighborhood for-purposes already permitted will riot be <br /> substantially impaired or diminished by the establishment, maintenance and operation of the proposed conditional use <br /> 3. That the establishment of the proposed conditional use will not impede the normal and orderly development and im- <br /> provement of the surrounding property for uses permitted in the district. <br /> 4. That adequate utilities, access roads, drainage and other necessary site improvements will ARII.be made. <br /> 5. That adequate measures will loft be taken to provide ingress and egress so designed as to minimize traffic congestion <br /> in the public streets. <br /> 6. That the proposed conditional use does— conform to all applicable regulations of the district in which it is pro- <br /> posed to be located. <br /> N For Conditional Uses in the A-1 Agriculture (Exclusive) District, the Following Additional Findings Shall be Made: <br /> 1. This use will not benefit the needs of either the residents or the agricultural activities in the area. <br /> 2. There are not other locations available for this use. - <br /> 3. The land to be occupied by this use is not productive agricultural land. <br /> 4. Public services needed by this use are not available. <br /> 5. Public services needed by this use can not be furnished without becoming an unreasonable burden on the taxpayers. <br /> 6. This use at this location will not cause significant harm to the environment. <br /> That the applicant has given the necessary guarantee detailed on Exhibit "A" attached hereto and incorporated by re- <br /> Nil ference. <br /> (That the conditions detailed in Exhibit "B" are specifically made applicable to this permit; and any violation of such <br /> conditions shall be sufficient grounds for revocation of this permit. <br /> WHEREFORE IT IS ORDERED: that the application for conditional use permit no. The mineral 'extraction shall be utilized only for the current USH 151 project <br /> starting in 1990. <br /> 2. The contractor that utilizes the mineral extraction permit for this site must <br /> have a contract for the USH 151 project. <br /> 3. The permit shall expire at the termination of the USH 151 project. •- <br /> 4.
