•
Mr. Ballweg also asked for C2 (1)(c) Sales of new and used motor vehicles. He
said that he just needed to be able to sell the equipment that they no longer needed. Legal
counsel advises me that Mr. Ballweg should be able to have a total 'occasional'sales each
year of 3-4 vehicles. If this is true, he should not need this zoning. He did not advise us
just how many pieces of equipment/vehicles he might need to dispose of each year. Please
clarify this one also if possible.
He also asked for C2 (1)(e) Sales of new and used contractor's machinery and
equipment. The reasoning was the same as(1)(c). We need this clarified.
The next request was for C2 (1)(f)Repairs, storage and service of contractor's
machinery and equipment. My understanding on this one is that it is the same as LC-1 (1)
(b)except for the limitation on the number of the pieces of equipment. This is where the
variance comes in to play, if we can do it.
The fifth request was C2(1)(h)Bulk fuel storage, sales and storage of lumber and
building material. Mr Ballweg advised us that he bulk purchases fuel for heating his home
and gas and diesel fuels. I have talked with DILHR and DACTP and can not get a
definitive definition on bulk fuel storage. Can you help on this one with how Zoning looks
at it?
The storage of lumber and building materials seem to me to be covered under
LC-1 (1)(e).
Lastly,Mr. Ballweg requested C2 (1)(i) Truck and bus terminals. Mr. Ballweg
informed us that he has approximately 11 truck, 21 tractors and 3 bobcats of various
types and sizes. Most of these items come and go in the course of business, although he
does collect antique Oliver farm tractors for a hobby. Again, I see most of this covered
or implied under LC-1 (1)(a).
Mr. Ballweg has some real problems that he has to address before the Town will
consider a variance on the number of vehicles, if that is a possibility.
The other problems he has to contend with is what is perceived by his neighbors
and the community as they travel by his property. This is a difficult issue to address. We
can hopefully work with him on the legal issues if you can furnish us some answers from
Zoning's position.
Mr. Ballweg or his representative and the Town will be available to meet with you,
if you desire to do so. Your attention to this matter will be appreciated.
You can reach me at (608) 798-2441.
cc: Ron Ballweg Melvem L. Bankes
