COMPOSITE REPORT - Page 2 APPLICATION NO. 6481/1301 <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 6481 - CUP 1301. This proposed commercial rezoning is an existing construction business, <br /> which has grown beyond the limits permitted by the LC-1 Limited Commercial District in the Town of <br /> Berry. <br /> This site is in the agricultural preservation area of the town/county plan in the Town of Berry where the <br /> following policy applies: <br /> Non-agricultural commercial uses will be limited to small contractors, vehicle storage, and <br /> limited outside storage of materials such as provided currently in the limited Commercial <br /> Zoning District. Rezoning for such uses shall be considered if the following criteria are met: <br /> - Minimal conflict with nearby residences and farm operations <br /> - No septic tank installation will be required to serve the use <br /> - The service offered is one generally needed by residents of the town <br /> - A minimal area is proposed to accommodate the specific use proposed <br /> These commercial rezonings will be conditional and will be subject to review upon change <br /> of ownership. <br /> Comments related to policies: <br /> - This business started as a small contractor, but has expanded and has a large garage and <br /> outdoor storage on-site. <br /> - This was a farmstead and has a reasonable separation from other farmsteads and rural <br /> residences in the area. <br /> - The contractor service is offered in the town and neighboring cities and villages. <br /> - The five acres proposed appears reasonable with the cluster of farm buildings and the added <br /> construction related building. <br /> - If the C-2 zoning is granted, it needs to be conditionally rezoned for a contractor business, <br /> since most of the other uses permitted by the C-2 district would conflict with the adopted <br /> policies. <br /> The Conditional Use Permit is for the existing residence, if the C-2 zoning is granted. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> None. <br /> DANE COUNTY HIGHWAY <br /> CTH"K" is not a controlled access highway. No apparent problems. <br /> OTHER <br /> None. <br />
