r- <br /> e......■a <br /> '4: <br /> (0 ORDINANCE AMENDMENT NO. 5706 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of <br /> WESTPORT <br /> The Dane County Board of Supervisors does ordain as follows: That the <br /> Zonin g District Maps of the Town of Westport be amended to include in the 3-1 <br /> Local Business District the following described land: <br /> Part of the N 1/2 NE 1/4 Section 23 and S 1/2 SE 1/4 Section 14, Town of <br /> Westport described as follows: Beginning at the corner common to Sections 13, <br /> 14, 23 and 24; thence S 02° 06' 46" West along the Section line between <br /> Sections 23 and 24, 1799.83 feet to a point that is N 02° 06' 46" East, 800.21 <br /> feet from the quarter corner common to Sections 23 and 24; thence N 52° 25 ' 42" <br /> West along the Northeasterly line of Certified Survey Map #1965. Dane County <br /> Registry to the centerline of River Road 2597.64 feet to the point of <br /> beginning. Thence N 24° 58' 10" East 516.81 feet; thence S 65° 01 ' 50" East <br /> 433.32 feet; thence N 70° 42' 48" East 182.50 feet; thence N 89° 36' 00" East <br /> 615.56 feet to City of Madison corporate boundary line; thence along said line <br /> S 33° 57 ' 58" West 24.23 feet to the North line of Section 23; thence <br /> continuing along the City of Madison coporate boundary line S 32° 14 ' West <br /> 1015.12 feet; thence N 52° 25 ' 42" West 1 ,064.62 to the centerline River Road <br /> and the point of beginning. <br /> F CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3) (a) 2. (b) <br /> of the Dane County Code of Ordinances. The rezoned area shall be subject to <br /> the following conditions. <br /> CONDITION <br /> 1 . The area of rezone shall include the building, parking area, proposed <br /> accessory building to be used for storage of lawn and yard maintenance <br /> equipment, the existing sign and any proposed recreational area. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane <br /> County the owner or owners of the land shall record the following restrictions <br /> on said land: <br /> A. Use of the property shall be limited to the following: <br /> 1 . A business college facility. <br /> 2. The college library may also include use by the public. <br /> 3. The college may provide office space for the Adult Christian <br /> Education Foundation. <br /> 4. Residential use shall be limited to students, faculty and resident <br /> caretaker of the business college. <br /> Said restrictions shall hall run in favor of Dane County and the pertinent Town <br /> Board as well as the owners of the land.
