• <br /> • . . <br /> t P 884 <br /> RESTRICTION AGREEMENT <br /> (Ziegler/Jankowski) <br /> WHEREAS, Roman Ziegler (the "Owner") is record title owner of the Property <br /> described at Exhibit A attached hereto and incorporated herein, located just east of CTH <br /> K, Waunakee, Wisconsin (hereinafter called the "Property"); and <br /> WHEREAS, Walter S. Jankowski and or Ronda M. Jankowski (collectively <br /> "Jankowski") may acquire a part of the Property to use for the repair and storage of <br /> trucks for their concrete business; and <br /> WHEREAS, the Owner has petitioned Dane County by Zoning Petition Number <br /> 6507, to rezone the Property from A-2 Agriculture to C-2 Commercial; and <br /> WHEREAS, the Town of Westport (the "Town") has approved of this rezoning <br /> subject to the following conditions and restrictions: <br /> (a) Execution of an agreement with the Town Board which stipulates that <br /> an application to rezone the Property to A-2 Agriculture shall be filed when the <br /> contemplated operation ceases or the Property is sold. <br /> (b) Use of the Property shall be limited to storing and repairing <br /> Jankowski's business vehicles and necessary parking. <br /> (c) Outside storage of business items, materials, or equipment is not <br /> permitted. <br /> WHEREAS, the Owner and Jankowski have agreed, and will execute and record <br /> said Restrictions in the Dane County Registry prior to Dane County issuing a zoning <br /> permit; and <br />
