After <br /> viewing a survey of the site and doing a field inspection it was determined that the outlet structure for the well <br /> discharge pipe on the property is essentially a navigable tributary or more likely a part of Lake Mendota for purposes of <br /> determining the OHWM as there is a distinctive difference between the presence of terrestrial vegetation and other <br /> easily recognized characteristics that separate it from the land, therefore any setback to the OHWM will be measured <br /> from that structure. <br /> 1 <br />
