MICHAELBEST &FRIEDRICH Dane County Zoning and Natural AnornysatLaw Resources Committee February 12, 1996 Page 2 Under the circumstances, we respectfully request that the following conditions be attached to the renewal of the Conditional Use Permit : (a) All slopes should be feathered to a usable grade not to exceed a 1-to-5 slope . (b) Sufficient clay and topsoil should be replaced on the excavated area so that the site can support normal residential landscaping. We estimate that the minimum combination of clay and topsoil needed to support such vegetation is from 10 to 12 inches . (c) The site should be seeded in a manner to provide sufficient cover to prevent further site erosion during the period prior to utilization of the site . (d) That Item 9 from the March 28, 1995 C.U. P. be stricken. This provision calls for a five (5) year limitation on the use of the site while soil structure is restored. The Van de Grift Trust and the City of Madison contemplate development occurring within a five-year period. (e) All of the remaining previous terms and conditions of the Conditional Use Permit issued to the Dane County Department of Public Works by the Dane County Zoning and Natural Resource Committee related to grading and restoration should be met . (f) The Dane County Land Conservationist shall be responsible for inspecting the site and certifying to the Committee that all of the conditions of restoration are met and the site will not suffer erosion or other environmental damage attributable to the clay removal or restoration operation. Certain issues regarding the deadline for completion of the above work and the restoration of the natural drainage are still being discussed by the Trust and the County and our failure to address those items in this letter should not be construed by the
