MICHAELBEST <br /> &FRIEDRICH Dane County Zoning and Natural <br /> Attorneys at Law Resources Committee <br /> February 12 , 1996 <br /> Page 2 <br /> so that the site is restored to a usable and environmentally stable <br /> condition upon its transfer to the Trust, we respectfully request <br /> that the following conditions be attached to the renewal of the <br /> Conditional Use Permit : <br /> (a) All slopes should be feathered to a usable grade not to <br /> exceed a 1-to-5 slope. <br /> (b) The site should be graded so that the stormwater runoff <br /> flows in its natural drainage pattern to the northeast <br /> toward Badger Mill Creek. This is the direction of the <br /> pre-excavation drainage . <br /> (c) A stormwater conveyance in the form of either a drainage <br /> swale or a storm sewer should be constructed to convey <br /> the runoff from the northeast corner of the 40-acre site <br /> to the North Fork of Badger Mill Creek. <br /> (d) Sufficient clay and topsoil should be replaced on the <br /> excavated area so that the site can support normal <br /> residential landscaping. We estimate that the minimum <br /> combination of clay and topsoil needed to support such <br /> vegetation is from 10 to 12 inches . <br /> (e) The site should be seeded in a manner to provide <br /> sufficient cover to prevent further site erosion during <br /> the period prior to utilization of the site . <br /> (f) That Item 9 from the March 28 , 1995 C.U. P. be stricken. <br /> This provision calls for a five (5) year limitation on <br /> the use of the site while soil structure is restored. <br /> The Van de Grift Trust and the City of Madison <br /> contemplate development occurring within a five-year <br /> period. <br /> (g) All of the remaining previous terms and conditions of the <br /> Conditional Use Permit issued to the Dane County <br /> Department of Public Works by the Dane County Zoning and <br /> Natural Resource Committee related to grading and <br /> restoration should be met . <br /> (h) The Dane County Land Conservationist shall be responsible <br /> for inspecting the site and certifying to the Committee <br /> that all of the conditions of restoration are met and the <br /> site will not suffer erosion or other environmental <br /> damage attributable to the clay removal or restoration <br /> operation. <br />
