This proposed residential division is in an Agricultural Transition Area of the Town of <br /> Oregon. Adopted town/county policy requires all of the following criteria to be met for rezoning: <br /> a) The activity allowed by the proposed rezone will not convert land that has been devoted <br /> primarily to agricultural use. <br /> b) The activity allowed by the proposed rezone will not limit the surround land's potential <br /> for agricultural use. <br /> c) The activity allowed by the proposed rezone will not conflict with agricultural operations <br /> on the land subject to a farmland preservation agreement. <br /> d) The activity allowed by the proposed rezone will not conflict with agricultural operations • <br /> on other properties. <br /> Comments related to criteria: <br /> These comments are corrected due to an error in the preliminary map received. <br /> a) This site appears to be a brushy knoll,which has not been farmed. The access from CTH"CC" <br /> passes through a small amount of farmland along the fence line to reach the site. <br /> b) Any time a non-farm residence is introduced into a farm field,there is a potential for limiting <br /> agricultural use in the immediate area. The access is adjacent to a non-farm residence to the east <br /> and the access is along the line fence which minimizes agricultural conflicts. <br /> c) The area is subject to the A-1 Agricultural Exclusive District and not a farmland preservation <br /> agreement. <br /> d) The active farmland on both the applicant's land and the neighbor's to the east is all south of the <br /> proposed site. <br /> As noted previously there is a non-farm home on the small lot to the east. Thus,this new parcel is not <br /> the first non-farm residence, and access is along the line fence. <br /> There is farmland to the south of CTH"CC"with two non-farm residences on the two lots to the <br /> southeast. Density is not an issue in the case. <br /> ENVIRONMENTAL HEALTH (septic, etc.), <br /> None. <br /> DANE COUNTY HIGHWAY <br /> CTH"CC"is a controlled access highway. Controlled Access Permit No. 95-22 granted access to <br /> this parcel upon approval of CSM. This access to serve all remaining frontage along CTH"CC". <br /> QTHER <br /> None. <br />
