1 <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6557 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Deerfield. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Deerfield be amended to include in the RH-2 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 6557 <br /> Part of the SE 1/4 NW 1/4 and the SW 1/4 NW 1/4 Section 19, Town of Deerfield <br /> described as follows: Commencing at the Northwest corner of said Section 19; thence S <br /> 00° 08' East, 273.84 feet ; thence S 72° 19' East, 1151.37 feet to the Northeast corner of <br /> Dane County Certified Survey Map Number#6893; thence S 05° 23' West along the East <br /> line of said Certified Survey, 809.35 feet to the point beginning; thence S 50° 16' East, <br /> 356.16 feet along the East line of Dane County Certified Survey Map Number #7611; <br /> thence S 36° 40' 13" East along said East line, 120.00 feet; thence S 86° 49' East, 476 <br /> feet to the center of a Town Road; thence N 02° 29' East along said center, 330 feet; <br /> thence West, 860 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezciited area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed descriptions is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. Subject to the recording of a deed restriction stipulating that the development rights on tax parcels 12- <br /> 071227490003 and 12-071234185704 shall be transferred to the rezone area and that no residential development <br /> shall occur on the parcels specified in the transfer of development rights. Said deed restriction shall be recorded <br /> with the parcels previously referenced as well as the rezone area itself. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site.
