Dane County Land Regulation & Records
February 6, 1996
Page 3
appropriate district, create parcel for a retirement home for the
farmer, separate farm buildings from the farm and sell balance of
cropland, etc. This information must be submitted at the time that
you file a petition to rezone:
The purpose of the rezone is to replace a one acre parcel at the north west
corner of the intersection of STH 113 and Clemens Road (the Clemens Road
parcel, No. 11-090813498509) which the owner had planned to use for a
residence. However, approximately 0.7 acre of the one acre Clemens Road parcel
was acquired by the Wisconsin Department of Transportation ("WDOT") to
improve the safety of those entering STH 113 from Clemens Road.
As consideration for the acquisition and the corresponding loss of Mr.
Meier's opportunity to have a residence at this location, the WDOT has agreed to
assist Mr. Meier financially in the rezoning. And, we believe that WDOT has also
obtained the support of Mr. Norbert Scribner for the substitution.
WDOT has, however, placed a deadline on Mr. Meier's petitioning for
rezoning, i.e., the rezoning petition must be filed within thirty (30) days of the
closing, which was January 26, 1996. The Meiers intend to build a new residence
within the next five (5) years or earlier if their financial circumstances will
warrant. Since the parcel is adjacent to the eastern edge of the corporate
boundaries of the Village of Dane, the rezoning is a logical extension of the
residential development which is occurring in the Village. Nevertheless, Mr.
Meier plans to continue farming land on this quarter section and the adjacent
quarter section for the foreseeable future.
6. Many Town Boards require a review of a proposed rezone prior to
the submission of a formal application. Please contact the Town
Clerk for specific information.
See the attached Exhibit B which is the approval by the Town of Dane
Town Board Chairman, Robert Lee. See also Exhibit C which is a letter of
support for the rezoning by State Representative Eugene Hahn.
