• 1 DANE COUNTY ORDINANCE AMENDMENT NO. 6580 Amending Section 10.03 relating to Zoning Districts in the Town of Pleasant Springs. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Pleasant Springs be amended to include in the RH-4 Rural Homes Districts the following described land: PETITION NUMBER: 6580 Part of the NE 1/4 SW 1/4 Section 11, Town of Pleasant Springs described as follows: Commencing at the Southwest corner of said Section 11; thence S 88° 56' 18"East on the South Section line, 1354.32 feet to the West line of Lot#1 of Certified Survey Map#7528 recorded in Volume 39 of Certified Survey Maps on Pages 82, 83 and 84, thence N 00° 06' 21" East on the West line of said Lot #1, 1324.00 feet to the point of beginning; thence continue N 00° 06' 21" East 1095.50 feet to the Southerly right-of-way of STH 90; thence Southeasterly along said South right-of-way line, 454.66' on the arc of a 4493.8 feet radius curve to the right having a chord bearing S 76° 33' 00" East, 454.47 feet; thence S 60° 24' 25" East along said right-of-way line, 349.19 feet; thence S 73° 39' 05" East along said right-of-way line, 621.00 feet; thence S 78° 51' 42" East along said right-of-way line, 5.69 feet to the East line of said NE 1/4 SW 1/4; thence S 00° 04' 18" East along said East line of NE 1/4 SW 1/4, 662.28 feet to the Southeast corner of said 1/4 1/4; thence N 89° 06' 58" West on the South line of said 1/4 1/4, 1350.14 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. Subject to the recording of a deed restriction requiring a signed site plan agreement between the Town of Pleasant Springs and the applicant, the signed site plan agreement shall comply with the Town of Pleasant Springs Town Land Use Plan specifically as it relates to not allowing non farm residences on soils classified as prime farm land. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void.
