COMPOSITE REPORT - Page 2 APPLICATION NO. 6523 <br /> STAFF COMMENTS <br /> REGIONAL PLANNING <br /> Petition 6523. This proposed division appears to conflict with the density policy of the county plan in <br /> the Town of Cross Plains. <br /> We note that this petition is for the same area, with the same effect, as Petition 6090(Public Hearing <br /> october 1994).Petition 6090 was subsequently vetoed In that petition,the request was for RH-2 and <br /> RH-4. <br /> The current petition(#6523)requests A-2(4)for a new residential lot(5 acres)and A-2 for the balance <br /> of the parcel(28 acres). <br /> The relevant policy is: "Lands in the agricultural district should not be rezoned for non-farm residential <br /> development at an overall density of greater than one dwelling per 35 acres owned as of the date of <br /> adoption of this plan." <br /> Since this area is designated as a Farmland Preservation Area on the town/county plan map,the policy <br /> does not allow for the division of the parcel because it is already less than 35 acres in size. <br /> We note that the Town of Cross Plains has adopted an"Interpretation"of their plan: "The Town of <br /> Cross Plains has ruled,by vote at our meeting of January 15, 1996,that we interpret our land use plan <br /> to apply the 35-acre density policy to farms,but not to nonfarm parcels."They have further indicated <br /> that this and other parcels of less than 35 acres are considered nonfarm parcels. <br /> The interpretation does not define nonfarm parcels and it does not state what policy is to apply to such <br /> parcels. This interpretation has been reviewed at the county level,but no action has been taken to <br /> amend the county plan. <br /> We have suggested several alternative amendments to the town/county plan to accommodate what is <br /> requested by petition 6523;however,town officials have not taken action to amend the plan. <br /> ENVIRONMENTAL HEALTH (septic, etc.) <br /> None. <br /> DANE COUNTY HIGHWAY <br /> None. <br /> OTHER <br /> None. <br />
