• <br /> Recommendation: <br /> In this case the proposed use is not in compliance with the Towns <br /> Plan which shows this area as agricultural and less than 1 <br /> dwelling unit per 35 acres . To be considered in compliance, the <br /> Plan and policy would need to be changed to recognize additional <br /> development at the proposed density. The Town Plan has <br /> established a list of criteria for consideration of proposals to <br /> change the plan map. These are: <br /> * Is the proposed amendment correcting an oversight or an <br /> error in the original plan? <br /> * Has a change occurred in the land development market, or <br /> have other factors arisen which justify a new form or type <br /> of development? <br /> * Has a new environmental protection method been found to be <br /> more effective? <br /> * Has a change occurred beyond the borders of the town that <br /> have caused travel and transportation patterns to change? <br /> * Has the community' s desires changed? <br /> * Is the Public ' s health, safety, and welfare preserved by the <br /> proposed change? <br /> Recommend denial of Rezone #6526 since Petitioner has failed to <br /> demonstrate or justify that a change in the Town' s Plan is <br /> warranted. <br /> Recommend denial of proposed preliminary CSM due to non- <br /> compliance with zoning requirements and insufficiency of <br /> application submittal . <br /> JB:jas <br /> 3 <br />
