I don't believe that I had copied this to you and I wanted it to be part of your file to reflect my attempts to be cooperative and try to get a driveway agreement on file. Text to Jason Schmid sent 10/28/15 at 11:39am: Hi Jason, we spoke at length with Wendy last night and she said she never intended to be part of any driveway discussions and was only going to be present as part of the HOA. We do not need to wait on her nor does she want any involvement in the driveway matter. You can confirm that with her. The county will be approving the zoning request and is giving you and I an opportunity to file a joint driveway agreement over the next couple weeks.This is an optional document and is not required for zoning. If no agreement is filed,the existing easement documents will just be relied on for basic usage. I would like to have one on file to document the shared responsibilities and expenses. Since this is technically your property,you would be responsible for repairs without an agreement. I would voluntarily contribute to any needs, however the shared agreement would ensure this as a requirement if there is ever a change in ownership. So essentially, this is up to you to be receptive to, and does not require involvement from Wendy or Jerry Derr. I have spoken with Jerry and he said the same thing as Wendy,that he is willing to stand by, but is not necessary. I have stated repeatedly that I want to work out an agreement with you. If you prefer to have one on file we should get started on drafts and get it done to both our satisfactions. I can send a draft your way by the end of the weekend for you to look over if you provide me with an email address to send it to. Otherwise you can certainly send one my way.Again my email is mountainfever33@gmail.com. I will be updating zoning with our progress. Of course if you have decided not to have an agreement on file, please let me know that as well.
