Fredrich <br /> Department of the Treasury <br /> Bureau of Alcohol, Tobacco and Firearms Date: February 5, 1996 <br /> 1000 North Water Street, Suite 1710 FFL # : 39-09033 <br /> Milwaukee, Wi. 53202 RE: MW:M 5340 <br /> Dear Ms. Fedrich, <br /> In response to your letter of 02/02/96 (copy enclosed). <br /> The home occupation permit I received does not prohibit retail sales from my home. 1 <br /> explained to the zoning department that I buy guns that need repair, maintainence or <br /> some cosmetic work, such as replacing sights, stocks, clips or other parts. I further <br /> explained that much of my business is sold to other dealers, at a profit, which means <br /> RETAIL SALES. Any time I sell a product for more than I paid for it, it is considered <br /> a retail sales. I further explained that I sell four or five guns from my home each year, <br /> and the zoning people assured me that this was permittable. The certificate of <br /> compliance prohibits me from building a retail outlet in my home. The Zoning permit <br /> does not allow signs advertising a business, a walk-in trade or a fully stocked business <br /> to operate. <br /> The Zoning prohibits an activity that has signs in the yard and prohibits me from <br /> converting part of the house into a store that may sell guns, scopes, fishing tackle, <br /> bows, arrows and other items that may make my property look like a K-Mart. <br /> I am a small business that retails four or five guns a year from the property, which is <br /> acceptable with the zoning department. I advertise in national publications, and sell <br /> guns to other dealers. The guns I ship to other dealers, I take to United parcel Service <br /> for shipment, which also is within zoning laws. The Certificate of Compliance is issued <br /> for small, part-time occupations that will not detract from the neighborhood and do not <br /> require a zoning change to commercial. <br /> The license I wish to renew Dealer (01) includes, but is not limited to GUNSMITH <br /> ACTIVITIES. In my business activities, I am a gunsmith who requires a license to buy <br /> and sell with other dealers, to purchase replacement parts at wholesale and sometimes <br /> sell a firearm. I do not sell stock or commodities on the premises on a regular basis. I <br /> do not operate a retail sporting goods store on the premises. The hours of operation <br /> listed on my application, reflect the hours I am usually home to receive a firearm from <br /> someone who wishes repair or maintainence on their firearms. Their firearms are <br /> dropped off and returned as soon as they are completed. Some may require repair parts <br /> which are ordered with a copy of my FFL, which allows wholesale purchase of parts. <br /> The repairs provide a profit, which must be reported to the state as retail sales and sales <br /> taxes must be paid <br />
