•A <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6588 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Berry. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Berry be amended to include in the RH-1 Rural Homes and RH-2 <br /> Rural Homes District/s the following described land: <br /> PETITION NUMBER: 6588 <br /> Part of the SE 1/4 SE 1/4 Section 34, Town of Berry described as follows: <br /> TO RH-1: Commencing at the Southeast corner of said Section 34; thence N 00° 44' <br /> 31" West 935.97 feet; thence S 89° 14' 47" West 60.00 feet; to the point of beginning. <br /> Thence continue S 89° 14' 47" West 434.81 feet; thence N 56° 34' 38" West 151.48 feet; <br /> thence N 55° 10' 39" West 77.39 feet; thence N 44° 34' 16" West 41.42 feet; thence N <br /> 89° 14' 47" East 651.78 feet; thence S 00° 44' 31" East 160.00 feet to the point of <br /> beginning. <br /> TO R11-2: Commencing at the Southeast corner of said Section 34; thence N 00° 44' <br /> 31" West 1095.97 feet; thence S 89° 14' 47" West 60.00 feet to the point of beginning. <br /> Thence continue S 89° 14' 47" West 651.78 feet; thence N 44° 3'4' 16" West 53.32 feet; <br /> thence N 61° 52' 42" West 80.79 feet; thence N 81° 58' 28" West 83.19 feet; thence N <br /> 83° 39' 26" West 103.12 feet; thence N 68° 57' 05" West 46.43 feet; thence N 04° 18' <br /> 05" East 116.82 feet; thence N 89° 23' 59" East 976.86 feet; thence S 00° 44'31" East <br /> 233.92 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.The recording of a deed restriction stipulating that there shall be no livestock on the rezone areas. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> -44 <br /> o. <br />
