DANE COUNTY ORDINANCE AMENDMENT NO. 6595 • M <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Rutland be amended to include in the A-2(8) Agricultural and RH-3 <br /> Rural Homes and RH-4 Rural Homes District/s the following described land: <br /> PETITION NUMBER: 6595 <br /> TO RH-3: Beginning at the Northeast corner of the NE 1/4 NW 1/4, thence South, <br /> 437 feet; thence N 88° 23' West, 767 feet to the centerline of Starr School Road; thence <br /> N 30° 28' West along said centerline, 495 feet; thence S 89° 55' East, 999 feet to the <br /> point of beginning. <br /> TO RH-4: Part of the NE 1/4 NW 1/4, and the NW 1/4 NW 1/4 of Section 13, and <br /> the NE 1/4 NE 1/4 of Section 14, Town of Rutland, described as follows: Commencing at <br /> the Northwest corner of the NE 1/4 NE 1/4 of Section 14; thence S 01° 47' East, 231 feet <br /> to the point of beginning; thence East, 3,100 feet to the centerline of Starr School Road; <br /> thence S 30° 28' East along said centerline, 110 feet to the Northeast corner of Dane <br /> County Certified Survey #1085; thence S 89° 59' West, 377 feet to the Northwest corner <br /> thereof; thence S 00° 05' East, 143.5 feet to the Southwest corner thereof, thence S 89° <br /> 59' West, 1442 feet; thence S 88° 09' West, 1334 feet to the West line of the NE 1/4 NE <br /> 1/4 of Section 14; thence N 01° 47' West, 240 feet to the point of beginning. <br /> TO A-2(8): Parts of the NE 1/4 NW 1/4 and the NW 1/4 NW 1/4 of Section 13, and <br /> the NE 1/4 NE 1/4 of Section 14, Town of Rutland described as follows: Beginning at the <br /> Northwest corner of Section 13; thence S 89° 55' East, 1670 feet to the centerline of Starr <br /> School Road; thence S 30° 28' East along said centerline, 220 feet; thence West 3,100 <br /> feet to the West line of the NE 1/4 of the NE 1/4 of Section 14, thence N 01° 47' West, <br /> 231 feet; thence N 89° 46' East, 1335 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. Subject to the recording of a deed restriction stipulating that there be no further divisions on the three rezone <br /> parcels and to prohibit residential development on the A-2(8)parcel. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone.toi a null and void. <br />
