• D NE COUNTY ORDINANCE AMENDMENT NO. 6606 Amending S L '6n 10.03 relating to Zoning Districts in the Town of Vermont. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Vermont be amended to include in the RH-1 Rural Homes District/s the following described land: PETITION NUMBER: 6606 Part of the SW 1/4 NW 1/4 of Section 5 and a part of the SE 1/4 NE 1/4 of Section 6 , Town of Vermont described as follows: Beginning at the East quarter corner of said Section 6; thence S 88° 57' 06" West along the East-West quarter section line of said Section 6, 500.38 feet to the centerline of CTH FF; thence N 45° 42' 58" West along said centerline, 179.87 feet; thence N 46° 06' 14" West along said centerline, 64.20 feet;thence N 88° 57' 06" East, 765.12 feet; thence S 04° 29' 43" East, 176.75 feet; thence S 89° 59' 12" East, 520.73 feet to a point on a meanderline of the East Branch of Blue Mounds Creek; thence S 16° 25' 29" West, along said meanderline, 196.93 feet to the Esat-West quarter section line of said Section 5; thence N 90° 00' 00" West along said East-West quarter section line, 349.89 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1.Subject to the recording of a deed restriction that restricts said rezone area to not more than 2 acres,that there shall be no further residential development on the remnant parcel of approximately 30.64 acres and that the applicant has no more development rights remaining. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. c\.\0 1
