• <br /> D NE COUNTY ORDINANCE AMENDMENT NO. 6606 <br /> Amending S L '6n 10.03 relating to Zoning Districts in the Town of Vermont. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Vermont be amended to include in the RH-1 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 6606 <br /> Part of the SW 1/4 NW 1/4 of Section 5 and a part of the SE 1/4 NE 1/4 of Section 6 , <br /> Town of Vermont described as follows: Beginning at the East quarter corner of said <br /> Section 6; thence S 88° 57' 06" West along the East-West quarter section line of said <br /> Section 6, 500.38 feet to the centerline of CTH FF; thence N 45° 42' 58" West along said <br /> centerline, 179.87 feet; thence N 46° 06' 14" West along said centerline, 64.20 feet;thence <br /> N 88° 57' 06" East, 765.12 feet; thence S 04° 29' 43" East, 176.75 feet; thence S 89° 59' <br /> 12" East, 520.73 feet to a point on a meanderline of the East Branch of Blue Mounds <br /> Creek; thence S 16° 25' 29" West, along said meanderline, 196.93 feet to the Esat-West <br /> quarter section line of said Section 5; thence N 90° 00' 00" West along said East-West <br /> quarter section line, 349.89 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Subject to the recording of a deed restriction that restricts said rezone area to not more than 2 acres,that there <br /> shall be no further residential development on the remnant parcel of approximately 30.64 acres and that the <br /> applicant has no more development rights remaining. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site.
