Smiley, Director ._5 <br /> Community and Regional Developm' <br /> DATE: June 20, 1996 <br /> RE: Zoning Petition 6614 — Town of Berry <br /> At the last meeting there was a question of how many land divisions were alloed for this farm <br /> property. <br /> The town/county plan in the Town of Berry states the general policy: "There will be a limit to <br /> the number of lots which may be created by certified survey of one parcel for each thirty-five <br /> acres, or portion thereof, owned as of the date of adoption of this plan." <br /> The plan goes on to specify the process for determining the number of lots: <br /> The owner of a parcel, or contiguous parcels totalling more than thirty-five <br /> acres may create that number of lots determined in the following manner. <br /> The total number of contiguous acres will be divided by thirty-five. If the <br /> resulting quotient is a whole number, the owner may create that number of <br /> lots. If the quotient is a whole number plus a fraction, the owner may create - <br /> that number of lots equal to the whole number plus one additional lot if the <br /> remaining fraction equals or exceeds 18/35. <br /> Ownership maps at the time of plan adoption show that this farm was approximately 160 <br /> acres.
