DANE COUNTY ORDINANCE AMENDMENT NO. 6617 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Mazomanie. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Mazomanie be amended to include in the A-2 Agricultural and RH-1 <br /> Rural Homes District/s the following described land: <br /> PETITION NUMBER: 6617 <br /> Part of E 1/2 of the NW 1/4 of Section 28, Town of Mazomanie described as follows: <br /> TO A-2: Beginning in Laws Drive 600 feet West of the North quarter corner; thence <br /> West 720 feet; thence South 1850 feet; thence Northeasterly along CTH Y 1400 feet; <br /> thence North 600 feet; thence West 350 feet; thence North 300 feet; thence East 250 feet; <br /> thence Northwesterly along centerline of Laws Drive 100 feet to the point of beginning. <br /> Part of the NE 1/4 NW 1/4 of Section 28, Town of Mazomanie described as follows: <br /> TO RH-1: Commencing 600 feet West of North quarter corner; thence Southeasterly <br /> along Laws 100 feet to the point of beginning; thence West 250 feet; thence South 300 <br /> feet; thence East 350 feet; thence North 250 feet to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed descriptions is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.Subject to the recording of a deed restriction prohibiting any residential development on the A-2 rezoning area. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause th m ne i null and void. <br />
