l <br /> DANE COUNTY ORDINANCE AMENDMENT NO. 6633 <br /> y;ding Section 10.03 relating to Zoning Districts in the Town of Dunn. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Dunn be amended to include in the A-2(1) Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 6633 <br /> Part of the NW 1/4 SW 1/4 Section 31, Town of Dunn described as follows: <br /> Commencing at the center of the intersection of Rutland-Dunn Town Line Road and <br /> Schuster Road; thence Northerly along the centerline of Schuster Road 325.0 feet; thence <br /> Easterly parallel with Rutland-Dunn Town Line Road 300.0 feet; thence Southerly parallel <br /> with Schuster Road 325.0 feet to the centerline of Rutland-Dunn Town Line Road; thence <br /> Westerly along the centerline of Rutland-Dunn Town Line Road to the point of beginning. <br /> Subject to a 33 foot public road right-of-way over the Southerly and Westerly side of said <br /> parcel. <br /> CONDTITONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. -- <br /> CERT'IF'IED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map will be prepared <br /> for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane <br /> County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County <br /> Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the <br /> recorded survey shall be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1.The rezone area shall be limited to approximately 2.24 acres and to require a deed restriction that restricts any <br /> future conditional use permits to only agricultural and residential use. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site.
