DANE COUNTY ORDINANCE AMENDMENT NO. 6661 Amending Section 10.03 relating to Zoning Districts in the Town of Blooming Grove. The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the Town of Blooming Grove be amended to include in the RH-1 Rural Homes District/s the following described land: PETITION NUMBER: 6661 Part of the SE 1/4 SE 1/4 of Section 2, Town of Blooming Grove described as follows: Commencing at the Southeast corner of said Section 2; thence N 00° 27' 33" West, 215.50 feet to the point of beginning of this description; thence S 87° 21' 03" West, 247.50 feet; thence S 00° 27' 33" East, 215.50 feet; thence S 87° 21' 03" West, 241.50 feet; thence N 05° 29' 30" West, 546.40 feet; thence on a curve to right of radius 1,462 feet whose long chord bears N 84° 04' East, 278.56 feet; thence N 89° 32' East, 259.29 feet; thence S 00° 27' 33" East, 336.72 feet to the point of beginning. CONDITIONAL ZONING Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of Ordinances. The rezoned area shall be subject to the following conditions. CERTIFIED SURVEY REQUIRED The above listed description/s is/are intended to describe land for which a certified survey map will be prepared for approval and recorded. This amendment will become effective, if within 90 days of its approval by Dane County,a certified survey map that describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the survey will cause the rezone to be null and void. Two copies of the recorded survey shall be submitted to Dane County Zoning. DEED RESTRICTION REQUIRED This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of the land shall record the following restrictions on said land: 1. Subject to the recording of a deed restriction prohibiting any livestock on the rezone area and to prohibit any conditional uses on the RH-1 rezone area. Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void.
