COMPOSITE REPORT Page 2 Application CUP 1351 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I. BACKGROUND <br /> A. The applicant requests a conditional use permit for an area already having C-2 and A-3 <br /> zoning. In order to be permitted a Conditional Use Permit is needed and is possible in <br /> both the C-2 and A-3 zoning districts. <br /> B. The property is between CTH CV and USH 51 on the north side of STH 19. The entire <br /> site is 150 acres. The site includes that area recently rezoned to C-2 in order to <br /> accommodate an industrial park. To accomplish the industrial park, a portion of the area <br /> has been approved for a preliminary plat but this has since expired, no final plat has yet <br /> been submitted. All of the CTH road frontage on the north side between this location <br /> and the Interstate is developed commercially. Most of the area on the south side is being <br /> developed commercially as well. <br /> C. In the recent past the applicants have been taking dirt off the A-3 area and filling in areas <br /> in the C-2 industrial park in order to level out such lots for better development potential. <br /> This has led to a protracted time period of dirt moving activities. It appears that such <br /> work may continue either at a large scale for a short period of time or at a lessor scale for <br /> a substantial period of time. Work such as this meets the definition of extraction <br /> activities in the zoning ordinance and the application has now been perused. <br /> II. ANALYSIS <br /> A. Most of the concern on this matter is centered on the need for logical plans on how to <br /> complete the earth moving for this project. In particular an Erosion Control Plan is <br /> needed. In the more general situation the need is for a plan covering several elements <br /> usually concerned with extraction activities. These could include dust plans, replacing <br /> the ground cover and doing enough study to ascertain which area will be cut and which <br /> will be filled as well as establishing a schedule so that realistic plans can be completed <br /> on all points. The area of the CUP is very large and it is unclear if the entire area is <br /> needed to be included in the CUP. <br /> B. This matter has been of great interest to the Town of Windsor. The Town will not take <br /> up this matter until 22 Aug. and may not complete action until a later date. Given the <br /> Town interest in this matter it is likely the Town will address the most pressing issues <br /> that have been raised. <br /> C. Dane County Environmental Health has no objections to the project. County Highway <br /> Department has no objections. Highway concerns should be minimal since this project <br /> will only deal with traffic internal to the project area and not with traffic leaving the site. <br /> D. The RPC comments that are also attached generally indicate that with the proper <br /> conditions the project is consistent with the development plans for the area. This would <br /> be expected given the recent approval of the rezoning for the commercial park. <br /> E. Since no Town action is available at this point staff is unable to report on that action. <br />
