fi
September 23 , 1996
Dane County Zoning
210 Martin Luther King Blvd.
Madison, WI 53703
RE: Zoning Petition #6666
The following are comments regarding the above petition:
Town Board approval of this position is in no way a violation of
the land use elan. The plan basically deals with farms while
this reauest is to split an existing non-agriculture lot of 2.1
acres. The owner wishes to make available a lot for her daughter
and her family.
It is difficult to understand why the zoning committee has raised
issues regarding the 1:35 acre concentration and possibility of
this parcel being split into as many as three lots for sale.
This is simply a mother helping, as best she can. a daughter.
Now the 1:35 acre comment does not belong in any commentary for
this town's plan. You will not find it in the town plan which by
action of the county board is also the county elan. Please note
that the ONLY place that the 1: 35 acre idea shows itself is from
the county executive who, for whatever reason, is trvina to
change the basis for approvals of rezones based on his opinion
and not by action that is required by the Town Board and changes
in the land use plan.
RPC is an advisory body and should not be using inappropriate
comments regarding the land use plan which they have when they
indicated that the concentration of the 1:35 acre was a problem
in this petition. I would recommend the RPC remove that comment
from their list of comments for all towns that do not have any
indication of a concentration factor of 1: 35 acre in their plans.
CONCLUSION
It seems apparent that the zoning committee has failed to
appropriately look at the above petition from the standpoint of
what is most appropriate from several aspects in dealing with it.
1. If this daughter is denied opportunity to build on this
split and still wishes to be in close proximity to her
mother, she will have to go out and purchase 35 acres,
thereby impacting the agricultural district of the township
for no reason.
