COMPOSITE REPORT Page 2 Application CUP 1355 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> I.BACKGROUND <br /> A. The applicant is requesting a Conditional Use Permit for a Day Care Center. This would be located in an <br /> existing single family home fronting on Williams Drive. The area is in a single family subdivision with <br /> single family homes on both sides and to the rear. The area across the road is largely vacant with one <br /> farmstead just north of the proposed site. <br /> B. The property is a larger single family house with no sewer service. The applicant has previously operated <br /> a Day Care operation for less that 8 children for 6 years at this location. The applicant now wishes to <br /> obtain a state license for more children that also puts the operation into a Conditional Use category. The <br /> application is for 16 children that corresponds to the State license that the applicant must have to move past <br /> the present category of operation. Applicant indicates that the need is more technical since they desire to <br /> operate at nearly the same level most of the time.On occasion,when school is in session,the siblings of 2 <br /> of the regular attendees need someplace to spend the day as well. This situation would happen about 25 <br /> days during the year. One additional employee will be needed for these days when the total number of <br /> children could reach 10 for a full day. Also there has been a need to keep 4 other siblings for up to an hour <br /> after school. This has been going on in the past but in order to clear this status with the State this should be <br /> included into the consideration. <br /> II.ANALYSIS <br /> A. One particular problem that is sometimes involved in Day Care is the ability of the sewage system to <br /> operate properly with numerous children. Dane County Environmental Health comments suggest that they <br /> would need to review the system for this facility. The applicant was contacted on this point and advised to <br /> contact Environmental Heath. Environmental Health has submitted a letter indicating that at the current <br /> level of operation the facility should be sufficient but that they would be concerned about an expansion. <br /> The proposed operation would not be considered an expansion for the purpose of Environmental Health. <br /> B. Staff would be concerned about a substantial Day Care operation on a road with a much traffic as <br /> William's Drive and 16 children in a regular operation. It appears that the children who stay for an hour <br /> are siblings of the regular attendee and really do not constitute additional traffic. The 2 additional children <br /> for 25 days a year are also siblings of regular attendees. As long as the project is really intended to <br /> operate at 8 or fewer children most of the time as it has in the past and only have additional siblings for a <br /> few days per year this concern should be alleviated. An approval by the ZNR should be able to limit the <br /> operation to 8 full time children year round,2 additional for up to 30 days per year and up to 4 additional <br /> for not more than 1 hour per day. <br /> C. Frequently neighbors would be very concerned about new Day Care facilities. The turn out at the town <br /> level only contained neighbors who were in support of the project. <br /> D. Applicants have asked that this item be considered for action at the Public Hearing meeting. Action for <br /> these items was taken up by the Town Planning Commission and obtained a preliminary approval. The <br /> Town will not take up this item for final approval until meetings in September so action by the ZNR <br /> Committee will not be possible. <br /> E. The fundamental concern for a variety of reasons is that the conditions of the CUP limit the operation to <br /> the general level the facility has operated at in the past. The granting of a license by the state for more <br /> children should not be considered an open approval to substantially expand the facility. This appears to be <br /> in keeping with the discussion that has taken place at the Town level to this point. <br />
