The Circuit Court, The Honorable Mark A. Frankel, presiding, <br /> has scheduled a trial on the annexation challenge for July 23, 1996. <br /> Target is hopeful that the annexation challenge will be dismissed at that <br /> time or shortly thereafter. <br /> Even if Judge Frankel dismisses the lawsuit, Plaintiffs are <br /> apparently taking the position that the reversion to county agricultural <br /> zoning under Wis. Stat. § 59.97(7) continues until all appeals are <br /> determined. <br /> Target believes that Plaintiffs' construction of § 59.97(7) is <br /> incorrect but out of an excess of caution petitions Dane County to <br /> rezone its site to C-2 Commercial District so that if it is determined <br /> that County zoning controls during the pendency of the appeal, the <br /> County zoning will allow Target to timely develop its property in a <br /> manner consistent with the recently adopted City zoning and conditional <br /> use permit. <br />
