COMPOSITE REPORT - Page 2 Application No. 6685 <br /> DANE COUNTY PLANNING DIVISION STAFF COMMENTS <br /> BACKGROUND <br /> A. The applicant is requesting C-2 zoning to allow the 101 acre subject property to be <br /> subdivided for commercial development. A preliminary development plan <br /> envisions a plat of approximately 30 lots and an internal road network. Lots would <br /> range from two to five acres in size. The applicant proposes to develop the <br /> subdivision with public sewer and water services. If this rezoning request is <br /> approved, the applicant's immediate plans are to locate his business near the <br /> northeast edge of the subject property. <br /> B. The subject property is located in the Town of Burke between USH 51, Anderson <br /> Road, I-90, and Hoepker Road. It is presently used for cropland, with three single <br /> family homes fronting on Hoepker Road. The Anderson Road frontage of the <br /> subject property is in the Burke Limited Service Area(LSA), where public sewer <br /> and water services are available. The vast majority of the subject property south of <br /> this frontage is not in the LSA. The parcel is within the City of Madison's <br /> extraterritorial plat review jurisdiction, roughly one mile from the City limits. <br /> C. On April 23, 1996, the ZNR Committee reviewed Petition#6576 which requested <br /> rezoning five acres on the northeast edge of the current subject property to C-2 to <br /> allow the applicant's proposed business. The Committee recommended approval <br /> of the petition subject to conditions that the Town of Burke Land Use Plan and <br /> LSA designations be amended consistent with the proposal. Because of concerns <br /> with these conditions, the County Board referred the petition back to Committee <br /> without taking action. The applicant does not wish to withdraw Petition#6576 <br /> pending action on Petition#6685. <br /> II. ANALYSIS <br /> A. The subject property is directly south of a C-2 zoned commercial area primarily <br /> occupied by vehicle sales and service uses. An auto body shop occupies the C-2 <br /> property bordering Hoepker Road and I-90 to the southeast. <br /> B. The proposed rezoning would be inconsistent with adopted town/county plans for <br /> this area(see attached RPC comments). Section 10.255(d) of the zoning <br /> ordinance indicates that"the Zoning Committee shall use plans and maps <br /> developed by individual towns and approved by the County Board as criteria for <br /> zoning recommendations to the County Board." The Town of Burke Land Use <br /> Plan was approved by the County Board in 1987 as part of the County Farmland <br /> Preservation Plan. That plan designates the subject property as an agricultural <br /> preservation area. The Town approved and forwarded a proposed update to its <br /> Land Use Plan to RPC in 1994, and forwarded an addendum to that update in June <br /> 1996 based on RPC comments on the 1994 plan. Due to remaining significant <br /> RPC staff concerns, the update has not yet been forwarded for adoption by RPC or <br /> the County Board. It identifies the subject property as appropriate for commercial <br />
