If this rezoning proposal is approved, the ZNR Committee and County Board may <br /> wish to consider delaying the effective date of approval until the significant issues <br /> are resolved. After consultation with the applicant, RPC staff, and Corporation <br /> Counsel, staff have prepared potential conditions of approval for the Committee's <br /> consideration. As proposed, the rezoning to C-2 would become effective only if <br /> all of the following conditions were satisfied within 15 months of approval by <br /> Dane County: <br /> 1. The Burke Town Board, Regional Planning Commission, Dane County Board <br /> of Supervisors, and State Department of Agriculture, Trade, and Consumer <br /> Protection approve a comprehensive update to the existing Town of Burke <br /> Land Use Plan following the procedures for review of town plan amendments in <br /> the Dane County Farmland Preservation Plan. This condition shall not be <br /> interpreted to imply that any of these decisionmaking authorities waives its <br /> discretion to approve or deny the comprehensive update. <br /> 2. The approved comprehensive update includes land use policies, a map and <br /> description of planned land uses, and planned delineations and phasing for urban <br /> and limited service areas. <br /> 3. Within the approved comprehensive update, the land use plan map designation, <br /> urban service area delineation and phasing plan, and all other policies and <br /> recommendations affecting the subject property are consistent with C-2 zoning, <br /> as determined by the Dane County Director of Planning and Development. <br /> 4. The Regional Planning Commission and State Department of Natural Resources <br /> approve designation and expansion of an urban service area to include the entire <br /> subject property. This condition shall not be interpreted to imply that either of <br /> these decisionmaking authorities waives its discretion to approve or deny a <br /> service area designation or expansion. <br /> 5. The applicant records an approved final plat for the subject property with the <br /> Dane County Register of Deeds. <br /> 6. The applicant and the Dane County Regional Airport execute an avigation <br /> easement to the benefit of Dane County with applicable height restrictions and <br /> noise disclosure over the entire property. <br />
