DANE COUNTY ORDINANCE AMENDMENT NO. 6685 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Burke be amended to include in the C-2 Commercial District/s the <br /> following described land: <br /> PETITION NUMBER: 6685 <br /> Part of the NE 1/4, SE 1/4 and SW 1/4 of the SW 1/4 Section 9, Town of Burke <br /> described as follows: Lots 1, 2 and 3, Certified Survey Map #6410, Town of Burke, Dane <br /> County, Wisconsin, along with all land located in the SE 1/4 of the SW 1/4 and all lands <br /> located in the SW 1/4 of the SW 1/4 Section 9, Town of Burke. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255-(3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> RECORDING OF AN APPROVED PLAT REQUIRED <br /> The above listed description/s is/are intended to describe land for which a plat will be prepared for approval and <br /> recorded. This amendment will become effective,if within one year of its approval by Dane County,a plat that <br /> describes the land to be rezoned is recorded in the office of the Dane County Register of Deeds. Failure'to <br /> record the plat will cause this amendment to be null and void. A copy of the recorded plat shall be <br /> submitted to Dane County Zoning. <br /> Conditonal Zoning: <br /> Contingent upon the following conditions being satisfied within 15 months of approval by Dane <br /> County: <br /> 1. The Burke Town Board,Regional Planning Commission,Dane County Board of Supervisors, and <br /> State Department of Agriculture,Trade,and Consumer Protection approve a comprehensive update to <br /> the existing Town of Burke Land Use Plan following the procedures for review of town plan <br /> amendments in the Dane County Farmland Preservation Plan.This condition shall not be interpreted to <br /> imply that any of these decision making authorities waives its discretion to approve or deny the <br /> comprehensive update. <br /> 2. The.approved comprehensive update includes land use policies, a map and description of planned <br /> land uses,and planned delineations and phasing for urban and limited service areas. <br /> 3. Within the approved comprehensive update, the land use map designation, urban service area <br /> delineation and phasing plan,and all other policies and recommendations affecting the subject property <br /> are consistent with the C-2 zoning, as determined by the Dane County Director of Planning and <br /> Development. <br /> 4. The Regional Planning Commission and State Department of Natural Resources approve <br /> designation and expansion of an urban service area to include the entire subject property. This <br /> condition shall not be interpreted to imply the either of these decision making authorities waives its <br /> discretion to approve or deny a service area designation or expansion. <br /> 5.The applicant records an approved final plat for the subject property with the Dane County Register <br /> of Deeds. <br /> 6.The applicant and the Dane County Regional Airport execute an avigation easement to the benefit of <br /> Dane County with applicable height restrictions and noise disclosure ovefi a entire property. <br /> SCREEN: a1 <br /> t - 1 <br /> LOGGED l6.___ <br /> • <br /> MAPPED: <br />
