This petition approval may be affected if applicable <br /> codes are revised prior to plan submittal for any necessary construction work. <br /> Comm 83.43 (8)(i)Table 1: The code section petitioned requires that a POWTS distribution cell(Dispersal <br /> Component)maintain a minimum horizontal setback of 10 feet from any building,water service or private water <br /> main,5 feet from a property line, 15 feet from a swimming pool,and 50 feet from the high water mark of navigable <br /> waters. <br /> The variance requested is to allow an existing POWTS distribution cell to be 6 feet from a new addition to the <br /> existing deck. <br /> The intent of the code section petitioned is to provide the minimum horizontal setback distances as outlined in table <br /> 83.43-I as extra safety factors for public health,waters of the state and structures during construction and in the event <br /> of component failure. <br /> The petitioner submitted the SB-9890 application form including 9 additional page(s)of supporting documents <br /> and/or plans. <br /> Reviewer's Comments: <br /> • The owner has agreed to put barriers around the mound during construct to prevent traffic over the mound. <br /> • The construction of the deck appears to have a crawl space,but no habitable area. <br /> Reviewer's Conditions of Approval: <br /> • All of the petitioner's statements of fact or intent included on the variance application form,any other <br /> documents submitted to the Department,as well as any other conditions of approval listed below,shall be <br /> carried out.
