2. After the commencement of the operation of the Manure Digester, one entrance to the <br /> Digester site, on Cuba Valley Road approximately 250 feet east of Ripp Lane, shall be <br /> allowed. Additional access points may be allowed by the Operator for agricultural uses on <br /> the Property. The Digester entrance road on Cuba Valley Road will be improved at the <br /> Operator's sole expense in accordance with standards set by the Town of Vienna to allow <br /> for safe truck movements in and out of the Digester site. The improvements will be made <br /> prior to the commencement of any hauling out of the Digester site except for hauling of <br /> material necessary to improve the intersection. <br /> 3. Haul roads will be maintained in a dust free manner in accordance with local, State, and <br /> Federal regulations. No Town roads other than an approximate 2,400 foot section of Cuba <br /> Valley Road and a 2,500 foot section of Old 113 Road between the Digester entrance and <br /> State Highway 113 will be used by trucks entering or leaving the digester site, except with <br /> the written approval of the Town Board. <br /> 4. The first 250 feet of the site access road south of Cuba Valley Road shall be paved and <br /> maintained as an asphalt surface road. <br /> 5. There shall be no hauling during any Town imposed seasonal weight restriction period <br /> without complying with the laws of the State of Wisconsin and/ or Town ordinances, unless <br /> special damage liability permits are applied for and granted by the Town. <br /> 6. Hours of Operation. Hours of operation for trucking shall be from 6:00 a.m. to 6:00 p.m., <br /> Monday through Sunday. These hours may be expanded with the written approval by the <br /> Town Board. <br /> 7. Stormwater Control. Stormwater issues related to the Digester operation shall be controlled <br /> by use of one or more of the following methods: grading, contouring, landscaping and the <br /> use of detention ponds. Stormwater within the Digester site shall be directed to detention <br /> areas. Stormwater management will be as shown in the storm water management plan <br /> approved by Dane County. <br /> 8. Impact on Groundwater. Excavation for the Digester site shall not extend below the ground <br /> water level and shall remain at a minimum of four (4) feet above the groundwater table. <br /> 9. Dust Control. Operator will maximize dust control on digester site haul roads in accordance <br /> with local, County, State, and Federal regulations. <br /> 10. Odor Control. Operator will maximize odor control on digester site in accordance with local, <br /> County, State, and Federal regulations. <br /> 11. Fuel Storage Buildings. Buildings shall be allowed or erected within the digester area. <br /> Fuel may be stored on the Digester site subject to any applicable building codes or other <br /> related safety codes. <br /> 12. Landscaping. Berms shall be at a slope not to exceed 3 to 1 and be mowed or otherwise <br /> maintained in a noxious weed free manner, as agreed to or as directed by the Town. <br /> 13. Roadway Maintenance. The Operator shall maintain Cuba Valley Road and Old 113 Road <br /> from the digester site entrance to State Highway 113 to a Paser Rating level of(7) seven, at <br /> operator's sole expense, until such time as the digester operation ceases all operations <br /> requiring digester site generated truck traffic on Cuba Valley Road. During the Operator's <br /> maintenance period, the Town may perform annual inspections of the road to insure proper <br /> maintenance. In the event the Operator fails to maintain the property as required by the <br /> Town, and in the event that the Town Engineer determines that truck traffic from the <br /> Operator's site has caused damage or deterioration, then the Operator shall be responsible <br /> for the road replacement or repair and the Town may draw on the bond or letter of credit as <br /> provided for in this Agreement. <br /> 14. Permits and Environmental Compliance. Operator shall Secure and maintain in full force all <br /> permits from any federal, State, County and local authorities necessary to open and operate <br /> the Digester operation and site. <br /> (continued to page 3) <br /> H:\Zoning\ZLR\Conditional Use Permits\CUP #2134.doc <br />
