(being a 10' wide easement) <br /> The Town shall have the right to place, construct, use, maintain, operate, alter, repair. replace <br /> and/or remove storm drainage facilities, either at or below the ground surface, including for such <br /> purposes the right to Ingress and egress and the right to preserve, protect, remove and plant thereon <br /> such vegetation as the Town may deem desirable to prevent soil erosion, in the Easement Arta. <br /> The undersigned further covenants not to•erect any structure upon the Easement Area that <br /> would interfere with the Town's use of said easement. <br /> This undersigned retains the full right to the use of the property subject only to the exercise of <br /> the specified rights of the Town in the Easement Area. <br /> The Town agrees to the following further conditions: <br /> • <br /> The Town will have the existing property pins referenced before construction and reset after <br /> construction by a registered land surveyor. <br /> Following completion of construction, the Town or its agents will cause the prompt restoration <br /> to smooth surface contours and return to a neat condition any portions of the land in the Easement Area <br /> which may have settled, All work, maintenance, operations and other actions thereunder shall be <br /> carried out In a workmanlike manner free and clear of liens and other encumberances, and said <br /> easement shall be maintained in such repair that no unreasonable damage will result from its use to the <br /> undersigned's adjacent land. <br /> The provisions of this easement shall be binding upon and shall Inure to the benefit of the <br /> parties hereto and their respective heirs, successors and assigns and the limitations contained herein <br /> .shell be covenants running with the land for the benefit of the grantor. grantee and their respective <br /> heirs, successors and assigns.
