DANE COUNTY ORDINANCE AMENDMENT NO. 6688 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Burke be amended to include in the M-1 Industrial District/s the <br /> following described land: <br /> PETITION NUMBER: 6688 <br /> Part of the NE 1/4 and NW 1/4 of the SE 1/4 Section 5, Town of Burke described as <br /> follows: Commencing at the East quarter corner of said Section 5; thence N 87° 27' 37" <br /> West, along the North line of the Southeast quarter of said Section 5, 424.43 feet to the <br /> point of beginning. Said point being on the East right-of-way line extended of the North- <br /> South part of Hoffman House Lane; thence S 02° 25' 25" West, along said East right-of- <br /> way line extended; 1259.95 feet to the north right-of-way line of the East-West part of <br /> Hoffman House Lane; thence N 87° 57' 39" West, along said North line extended, 864.18 <br /> feet to the Easterly right-of-way line of Interstate Highway 90-94; thence N 38° 03' 21" <br /> West, along said Northeasterly right-of-way line 1032.22 feet; thence N 50° 21' 35" West <br /> along said Northeasterly right-of-way line 801.89 feet to the East-West quarter line of said <br /> Section 5; thence S 87° 27' 37" East, along said East-West quarter line 2172.85 feet to <br /> the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b)of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. That item 10.15 (1) (lc) shall not be a permitted use in the M-1 district and that there shall be no structural <br /> development in the area not included in the Limited Service Area and that this area is to be limited to only <br /> parking,landscaping and signs. <br /> Said restrictions shall run in favor of Dane County and the pertinent Town Board as well as the owners of land <br /> within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null and void. <br /> � f'c L,c 11 15 <br />
