4. That adequate utilities, access roads, drainage and other necessary site <br /> improvements have been or are being made. <br /> 5. That adequate measures have been or will be being taken to provide ingress and <br /> egress so designed as to minimize traffic congestion in the public streets; and <br /> 6. That the conditional use shall conform to all applicable regulations of the district in <br /> which it is located. <br /> 10.123(5) Standards for conditional uses in the A-1 Exclusive Agriculture zoning district. <br /> In addition to the requirements of s. 10.255(2)(h), the zoning committee must find that the following <br /> standards are met before approving any conditional use permit in the A-1(exclusive agriculture) <br /> zoning district. <br /> (a) The use and its location in the A-1 Exclusive Agriculture zoning district are consistent <br /> with the purposes of the district. <br /> (b) The use and its location in the A-1 Exclusive Agriculture zoning district are reasonable <br /> and appropriate, considering alternative locations, or are specifically approved under state <br /> or federal law. <br /> (c) The use is reasonably designed to minimize the conversion of land, at and around the <br /> site of the use, from agricultural use or open space use. <br /> (d) The use does not substantially impair or limit the current or future agricultural use of <br /> surrounding parcels of land that are zoned for or legally restricted to agricultural use. <br /> (e) Construction damage to land remaining in agricultural use is minimized and repaired, to <br /> the extent feasible. <br /> POTENTIAL CONDITIONS OF APPROVAL FOR CUP 2136 <br /> Conditions are based on those the ZLR commonly apply to permits for mineral extraction <br /> operations, customized to the particular site and operation, including conditions proposed by the <br /> applicant and reviewed and approved by the town. The following list reflects the county's standard <br /> conditions blended with those that were proposed by the applicant and requested by the town of <br /> Christiana. <br /> 1. The applicant shall maintain the existing Dane County erosion control and storm water permit in <br /> active status for the entire site for the duration of the mineral extraction operation. <br /> 2. The operator shall apply for, and receive all other required local, state and federal permits and <br /> licenses. <br /> 3. The applicant shall meet DNR standards for particulate emissions as described in NR 415.075, <br /> Wisconsin Administrative Code. <br /> 4. The operator shall develop and operate the site according to the site and operations plan that is <br /> part of the application for this permit. <br /> 5. Operations shall cease no later than ten (10) years from the date of issuance of the conditional <br /> use permit. <br /> 6. Reclamation shall be completed within one year after operations have ceased, and shall be <br /> phased according to the operations and reclamation plan. <br /> 7. Reclamation shall meet requirements of Chapter 74 of the Dane County Code of Ordinances <br /> (DCCO). <br /> 8. The operator shall post and maintain at all times a bond or irrevocable letter of credit in favor of <br /> Dane County, as required by Chapter 74 of the DCCO, to ensure compliance with the <br /> reclamation plan. <br /> 9. The driveway accessing the site shall be maintained as paved and maintained in a dust free <br /> CUP2333 3 <br />
