DANE COUNTY ORDINANCE AMENDMENT NO. 6740 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Burke. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District Maps of the <br /> Town of Burke be amended to include in the C-2 Commercial District/s the following described land: <br /> PETITION NUMBER: 6740 <br /> Located in the SE 1/4 of the SE 1/4 of Section 5 and in the NE 1/4 of the NE 1/4 of Section 8, all in <br /> Town of Burke described as follows: Commencing at the North quarter corner of said Section 8; thence <br /> S88°22'27" East 1416.73 feet along the North line of said NE 1/4 of Section 8, to the point of beginning. <br /> Thence continue S88°22'27" East 12.00 feet to the Easterly line of Daentl Road; thence NOl 026153" <br /> East 240.51 feet along said East line of Daentl Road; thence S68°54'08" East 163.57 feet; thence <br /> S88°22'27" East 240.08 feet to the Westerly line of Interstate Highway 90-94; thence S05°39'52" West <br /> 88.13 feet along said Westerly line; thence S10°30'57" West 115.79 feet along said Westerly line; thence <br /> S89°56'00" West 170.80 feet; thence S00°04'00" East 19.71; feet thence S29°41'57" East 30.45 feet; <br /> thence S72°08'35" East 42.23 feet; thence S09°02'19" West 51.82 feet; thence S40°39'56" West 79.95 <br /> feet; thence S10°58'42" West 63.39 feet; thence S27°28'07" West 52.29 feet; thence S25°42'55" West <br /> 56.43 feet; thence S11°25'31" West 53.59 feet; thence S12°32'00" West 59.00 feet; thence N89°45'01" <br /> West 123.04 feet to the Easterly line of Daentl Road; thence N00°14159" East 467.33 feet along said <br /> Easterly,line to the point of beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255 (3)(a) 2.(b) of the Dane County Code of <br /> Ordinances. The rezoned area shall be subject to the following conditions. <br /> 1). Receive DNR approval of field-delineated wetland boundaries on the site. The boundary of the C-2 <br /> shall be adjusted to avoid wetland areas. <br /> 2). Obtain a stormwater and erosion control from Dane County Zoning. . <br /> 3). Provide the Zoning Administrator a site plan and landscaping plan , approved by the Town of <br /> Burke, conforming to 10.16(7) DCCO. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective, if within 90 days of its adoption by Dane County the owner or owners of <br /> the land shall record the following restrictions on said land: <br /> 1). The uses on the property are limited only to parking and storage of motor vehicles as per <br /> 10.14(1)(q) <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners <br /> of land within 300 feet of the site. Failure to record the restrictions will cause the rezone to be null <br /> and void. <br />
