We the undersigned, oppose zoning petition for Ronnie <br /> Frederick and Charles Malkowski for the followi ns: <br /> 1) The area is in or adjacent to Cherokee Marsh and/or wetlands <br /> which are environmentally sensitive areas. Any fuel or oil spills, <br /> runoff from paved areas or seepage through gravel or dirt parking <br /> areas would be extremely hazardous to this and the surrounding <br /> wetlands. <br /> 2) This area is not suitable for further commercial development <br /> or the resulting increased commercial truck traffic which could <br /> further harm an already deteriorating town road. <br /> 3) Mr. Frederick has been and is still operating with an expired <br /> C.U.P. , due to his failure to renew it. <br /> 4) On numerous occasions Mr.Frederick has been in violation of <br /> his previous C.U.P. by as many as 7 - 8 semi tractors & trailers. <br /> These violations have been reported to three different Town of <br /> Burke Town Clerks as well as Dane County Zoning by several area <br /> residents. <br /> 5) Mr. Frederick has admitted verbally and in writing that he has <br /> been and is still operating a Semi Truck repair shop at this <br /> residence. This is illegal and another violation of his C.U.P. . <br /> 6) Mr. Frederick has continued to operate as he sees fit despite <br /> warnings from the Town of Burke and a written Cease & Desist order <br /> from Dane County Zoning. <br /> No further complaints have been filed because area residents <br /> opposed to Mr. Frederick's petition have been trying to settle this <br /> matter through the process of public hearings at the Town level. <br /> 7) The Town of Burke Planning Commission held two public hearings <br /> on this matter and upon a physical inspection of the area by the <br /> Planning Commission Chairman, who also found Mr. Frederick in <br /> violation, recommended denial of Mr. Frederick's petition for a <br /> zoning change. <br /> 8) We question why the Burke Town Board would choose to support <br /> a zoning change without a physical inspection of the property, with <br /> documented past complaints and lack of consideration of a Town <br /> Planning Commission recommendation.
