Statement for Vang's Rezoning Petitioner <br /> September 23, 1996 <br /> As you may recall, in 1995 I petitioned and rezoned this 12 acres of RH 3 into 1 <br /> lot of RH2 and 3 lots of RH1. The original intention was to divide the 12 acres into 4 <br /> lots. The Town of Sun Prairie and I were not able to resolve how the CSM and the <br /> dedicated road would be soon after the rezoning was approved. There is deadline <br /> that if the CSM was not recorded by certain date, the rezoning would be lost. <br /> Therefore, to preserve the new zoning the Town and I agreed to record a CSM at the <br /> time only for 2 lots, 1 as RH 2 (lot 2) and 1 as RH1 (lot 1), with the understand that the <br /> Town and I will continue to talk and will do another CSM for lot 1 to divide it further into <br /> 3 lots. When we did the first CSM and was recorded on February 26,1996, we only <br /> reserved enough land area in lot 1 for a straight 66 feet wide right-of-way for the future <br /> dedicated town road and 700 feet long. Recently, the Town has approved a CSM to <br /> divide lot 1 into 3 lots and where the dedicated road is going to be located. As you can <br /> see in the attached proposed rezoning map, the future dedicated road is not straight <br /> but curved a little. Because of the curve, my engineer calculated that the future <br /> dedicated road now is longer than 700 feet and therefore will require more land area <br /> than what we reserved for it earlier. When the dedicated road takes more land area <br /> away, we don't have enough land area for 3 lots of RH1 each anymore because RH1 <br /> lot requires a minimum of 2 acres land. This problem was anticipated before until we <br /> were ready to plan and construct the road this month.. <br /> The Town, Mr. Norbert Scribner, and I discussed this at length. It was decided <br /> that a variance to build a future dedicated road of less than 66 feet wide right-of-way is <br /> not the recommended way to dot it. The proper solution is to rezone the land so one of <br /> the proposed 3 lots in lot 1 does not need a minimum 2 acres size. At the Town <br /> Meeting on September 18, 1996, I was asked to proceed with the rezoning process <br /> immediately. <br /> This rezoning petition is not to divide the land into more parcels or lots than the <br /> 4 lots that you approved in late 1995. This is just to make it possible for those 4 lots <br /> that you already approved. The proposed new lot 1 and 2 will stay the same as RH1 . <br /> This rezoning is only for the new proposed lot 3, as the attached legal description <br /> describes. <br /> Therefore, I respectfully request your approval of this petition.
