DANE COUNTY ORDINANCE AMENDMENT NO. 6760 <br /> Amending Section 10.03 relating to Zoning Districts in the Town of Rutland. <br /> The Dane County Board of Supervisors does ordain as follows: That the Zoning District <br /> Maps of the Town of Rutland be amended to include in the RH-1 Rural Homes District/s <br /> the following described land: <br /> PETITION NUMBER: 6760 <br /> A parcel of land located in the SE 1/4 NW 1/4 and the NE 1/4 of the NW 1/4 Section 18, <br /> Town of Rutland described as follows: Commencing at the Southwest corner of the <br /> Northwest quarter of said Section 18; thence N 86° 09' 01" East, 2291.78 feet along the <br /> South line of the NW 1/4 of said Section 18; thence N 00° 33' 48" West, 984.23 feet <br /> along the West right-of-way line of Mesa Drive; thence N 24° 58' 21" West, 70.50 feet to <br /> the Northeast corner of Lot #1 of CSM#7316 and to the point of beginning; thence S 85° <br /> 35' 58' West, 75.84 feet along CSM #7316, thence N 02° 46' 43" West,715.27 feet; <br /> thence N 89° 42' 49" East, 320.00 feet; thence S 02° 46' 43" East, 738.32 feet; thence S <br /> 85° 35' 58" West, 132.91 to a point on Mesa Drive; thence 203.84 feet along the arc of a <br /> curve concave to the South having a radius of 60.00 feet, a central angle of 194° 39' 11", <br /> a chord length of 119.02 feet and a chord bearing of N 71° 39' 53" West, to the point of <br /> beginning. <br /> CONDITIONAL ZONING <br /> Conditional zoning is hereby imposed pursuant to Section 10.255(3)(a)2.(b) of the Dane <br /> County Code of Ordinances. The rezoned area shall be subject to the following conditions. <br /> CERTIFIED SURVEY REQUIRED <br /> The above listed description/s is/are intended to describe land for which a certified survey map <br /> will be prepared for approval and recorded. This amendment will become effective, if within <br /> 90 days of its approval by Dane County, a certified survey map that describes the land to be <br /> rezoned is recorded in the office of the Dane County Register of Deeds. Failure to record the <br /> survey will cause the rezone to be null and void. Two copies of the recorded survey shall <br /> be submitted to Dane County Zoning. <br /> DEED RESTRICTION REQUIRED <br /> This amendment will be effective,if within 90 days of its adoption by Dane County the owner or owners of the <br /> land shall record the following restrictions on said land: <br /> 1. To prohibit any further divisions of parcel#s 0510-181-8189-8, 181-8680-3, 181-9000-3, 181-9500-8, <br /> 182-8181-6, 182-9501-6. <br /> Said restriction shall run in favor of Dane County and the pertinent Town Board as well as the owners of <br /> land within 300 feet of the site.Failure to record th estrie ions will cause the rezone to be null and <br /> void.
